Federal Courts Affirm Day Laborers' Constitutional Rights To Solicit Work on Public Streets and Sidewalks

Los Angeles, CA – Today, federal courts affirmed that day laborers’ have the Rights to solicit work on public streets  Solicit Work on Public Streets and Sidewalks. Specifically, the Second Circuit Court of Appeals affirmed the decision of the United States District Court for the Eastern Division of New York holding that the Town of Oyster Bay’s anti-day labor ordinance violates the First Amendment. The ordinance, which made it illegal to solicit day labor on public streets and sidewalks, has been permanently enjoined.

Jessica Karp Bansal, Litigation Director of the National Day Laborer Organizing Network, which filed a “friend of the court” brief in the case said:

“Today’s victory is the latest in a long line of decisions affirming the constitutional right of day laborers to gather peacefully in public and look for work. It provides a forceful rebuke to anyone that seeks to criminalize workers for trying to put food on their families’ tables.  It also offers an inspiring example of migrant workers standing strong to defend the fundamental freedoms of all people in this country despite the hate, fear, and white supremacy emanating from the White House.
